re: [Updated]Abu Qatada's deportation appeal REJECTED

It would have been Home Office civil servants that gave the info. Eg If there is a time limit of 'within a week', and that is stated on a Monday @2pm. Is the deadline just after midnight of Sunday(ie early Monday), 2pm the following Monday or midnight the following Monday.

His lawyers missed the first 2 options and the 3rd is more than the time limit of 'within 3 months'. I suppose the precise issue hasn't come up before, because normal people wouldn't leave it until a matter of a couple of hours before the latest of the 3 possible deadline times.

Article four of the European Convention on the Calculation of Time-Limits says: "A time limit expressed in months… expires on the day of the last month whose date corresponds to that of the dies a quo."
It provides an example: "A time limit of one month starting on 5 January expires on 5 February; starting on 30 April, expires on 30 May (not on the last day of May

re: [Updated]Abu Qatada's deportation appeal REJECTED

If as in that example something expires on 5th Feb, then doesn't that mean it has expired on that day and is not valid on that day, and the time deadline was at the end of 4th Feb. That would mean that the Home office got it right.
Quote:
Article 2
For the purpose of this Convention the term dies a quo means the day from which the time-limit runs and the term dies ad quem means the day on which the time-limit expires.
Article 3
1. Time-limits expressed in days, weeks, months or years shall run from the dies a quo at midnight to the dies ad quem at midnight.
2. However, the provisions of the foregoing paragraph do not preclude that an act which is to be performed before the expiry of a time-limit may be performed on the dies ad quem only before the expiry of the normal office or business hours.
The clock started ticking at midnight on the day the judgment was given ie before the judgment. If a time limit was one day then the deadline would have passed before the judgment. It a time limit was 2 days, there would be less than 24 hours, ie from time of judgment to 23:59:59 that same day.

In this instance the judgement was issued on 17th Jan, the deadline was therefore midnight of the 17th Apr ie end of 16th Apr. If the office hours exception applied, then they were still late as the appeal was lodged around 22:00BST on 17th Apr.

It's probably a temporary aberration sadly...

However whilst we should rejoice at this news, let's not assume this despicable man is going anywhere soon.

I hope it is temporary tbh, there are british hostages overseas that have been threatened with execution if he goes to Jordan I think we should find them and get him back before he goes anywhere.

Quote:
Home Secretary Theresa May said: "It has always been the government's intention that the Qatada case should be heard in the British courts, so I am pleased by the European Court's decision today.

"I remain confident that the assurances I have secured from the Jordanian Government mean we will be able to put Qatada on a plane and get him out of Britain for good.

"His case will now go through the British courts, and in the meantime, because of the action taken by the government, Qatada remains behind bars."

If what the British courts have been dishing out lately. I seems like he could be staying?

Hope not

Yes that's concerning of course but if his fanatic supporters want to kill innocent Brits they don't need hostages to do it and even if we got them all home safe there'd be no way to prevent more being taken.

No that's all true but imo we should just stall them a bit until we find him, when you consider what Qatada being here has already cost us in cold, hard cash a bit more won't hurt.

Looks like they scraped past by the skin of their teeth. I wonder if someone will be getting a kicking at the home office for not getting the timings right.
