The government has signed a mutual assistance treaty with Jordan to ensure that radical cleric Abu Qatada can be extradited, Theresa May has told MPs.

The home secretary said the treaty had guarantees on fair trials within it.

The government is doing "everything it can" to deport Abu Qatada, she said.

The move comes after she failed to get the case referred to the Supreme Court to reverse a ruling that the radical cleric could face an unfair trial if sent to Jordan to face terror charges

At least she keeps trying.

Mrs May is to apply directly to the Supreme Court for permission to challenge that ruling.

The treaty would come into play should the Supreme Court reject the government's request.

The radical cleric says he will voluntarily go back to Jordan if a no torture treaty is ratified as his bid for bail is adjourned. Abu Qatada has agreed to voluntarily return to Jordan if the country's parliament ratifies a treaty with the UK guaranteeing that he will not be tortured.

His co-operation was announced by his barrister, Edward Fitzgerald QC, at the beginning of an immigration tribunal to decide whether Qatada could be released from prison.

Whats he up to ?

He's jumping before he's pushed. One of his lawyers has told him once the treaty is ratified he will lose any court case based on it, so he might as well walk out voluntarily and make himself look like the principled good guy.

The treaty is now awaiting approval by Jordan's King Abdullah - the final key stage before the deal becomes law.
The vote in Parliament means the process to deport the radical cleric is likely to resume within weeks.

Jordan expects Abu Qatada's arrival on Sunday

Home Office reportedly plans to fly Islamist cleric out of Northolt airport in west London at 2am on Sunday

"Abu Qatada is expected to leave Britain in the early hours of Sunday and should arrive in the morning in Jordan on the same day," the official told the AFP news agency.
