That's quite right, the DCMS made that very clear in the document I linked a few posts back. Unfortunately, the Government has back tracked from the original stance, the culture minister Lord Ashton said "we think it should be left to the market to decide that", when speaking about the possibility of Virgin Media being billed as a result of the repeal of cable's copyright exemption.

Of course, there has been an election since the original DCMS opinions were published and the current administration may hold a different view.

Sky have longer to negotiate, it won't really bother them until IPTV delivery of linear channels hits significant numbers. They also have time to build a Freeview hybrid platform and avoid any retransmission fees.
