Wait till March then upgrade?

When you say flat at 40% what actually happens with the phone?

thread moved as not a VM phone.

If it's dead at 40% then it's probably a duff battery. the mAh of the battery is probably not at max capacity.

the mail app/location services can be a big drain on the battery. as well as any apps running in the background.

if the phone was jailbroken you could install 'battery detective' and as from my ipad it will tell you

Current capacity - 1260mAh
Max capacity - 4343mAh
Design capacity - 4490mAh
Battery charge - 27.95%
Drain - -465mA

So your Max capacity could be really low compared to the Design capacity.

But saying that. on one of my iPhone 3GS's that has a low max capacity. but it just drops rapidly down the bottom end. it wouldn't say 40% and be actually 2%.

there's a lot of people suffering the same thing with iPhone 4S and iOS7 (a quick google search will show this). since the update, the battery shows anywhere from 40% to 0% but suddenly dies, seemingly randomly. mine does it, as does a friends and his wife's, ONLY since the iOS7 upgrade. on iOS6, the phones were absolutely fine and never failed to give an accurate reading.

although your issue may well be a faulty battery, bear this bug in mind.
