From the VM site (http://allyours.virginmedia.com/html/internet/traffic.html)

In areas where 10Mb speeds are available, the top 3% of downloaders download at least 800MB of traffic each during the peak period each evening, with the top 3% of uploaders uploading at least 400MB of traffic in the same period.
Any users hitting this amount during peak times (4pm till 9pm) will have their broadband speed temporarily traffic managed – their download speed will be set to 2.5Mb, with their upload speed set to 128Kb. This will last for 5 hours from when the traffic management policy is applied.

So, if these rules are applied, if you hit the 800MB limit at 8:30pm, you will be limited until 1:30am.

Unless you are in Preston, Wigan, Blackpool, Camden, Dalston, Enfield or Haringey, in which case you'll be part of the STM trials (http://www.cableforum.co.uk/board/12/33631495-stm-statement.html?highlight=STM+Statement).

It can start between 4-9pm, but once it has started, it lasts for 5 hours.

So....

You hit the limit at 5pm, you are STM'ed until 10pm
You hit the limit at 6:15pm, you are STM'ed until 11:15pm
You hit the limit at 8:30pm, you are STM'ed until 01:30am
You hit the limit at 8:59pm, you are STM'ed until 01:59am

or, as ceedee states, you are part of other "trials", where these limits/times apply

10am - 3pm Download only
4pm - 9pm Download
3pm - 8pm Upload

During these times the following thresholds will be applied for upstream and downstream.
10am - 3pm Download
Size L: 2400Mb

4pm - 9pm Download
Size L:1200Mb

3pm - 8pm Upload
Size L: 700Mb

How do you find out if you are in the top 3% of up and downloaders ?

Check how much traffic you generate during the peak hours of 4pm-9pm using a connection manager, such as DU Meter (http://www.dumeter.com) or BitMeter (http://codebox.no-ip.net/controller?page=bitmeter2).

According to VM, you're one of the 3% if you download 3GB (or upload 1250MB) on a 20Mb/s XL connection during those peak hours.

Ah... that is the golden question in my opinion, because I bet a lot more than 3% exceed the stm limits.

You are correct.
I've only read of two occasions where UBRs had the wrong STM settings but it's a possibility.
Grab a connection meter application so you can be certain of your traffic volumes and report anything weird to Tech Support?

I use DU Meter -- fantastic, detailed reports but it's only really suitable if you're mainly using just the one pc.

Every time you download anything, you send ACK packets back up the line for each incoming packet.

ACK is short for ACKnowledgement incase you wondered.

Erm, then you were STM'd between 4pm-9pm...?

If you hit the Quote button on the post with the cap times that you don't understand (and then edit out the text that's irrelevant), then somebody can try to explain them further?

woops.. sorry your right.. should have been more clear:

4pm - 9pm Download
Size L:1200Mb

3pm - 8pm Upload
Size L: 700Mb

since I started after 8pm ... I should have fallen under the 4pm-9pm bracket where I could download 1200Mb .. was the first the connection had been used today.

Yep.
I've seen several reports of STM cutting in sooner than expected on the Tech Support newsgroup. But unfortunately quoting traffic monitoring application stats hasn't yet convinced the techs that they are anything but a few isolated problems.
If the problem persists, I'd recommend you report it via the newsgroup and ask how they'd like you to record the evidence.

On a plus-note: VM's Alex Brown has confirmed that they've requested a software update that'll mean that each STM 'penalty' will stop at the end of the peak period rather than continue to the end of five hours.
But don't hold your breath -- I get the impression it's not going to happen for a while.

While alex is telling the truth on that point, he and others asked cisco for that required update a LONG time ago...and cisco hasnt really bothered to move on the subject...

LOL

I'd heard it rumoured several times but his post today was the first 'official' acknowledgement I'd seen.
