Help clarifying home delivery clause...

Hi,
Last year 02 totally screwed up delivery of my current Iphone. To cut a VERY long story short I ended up with three handsets, 02's system say I only have one phone despite numerous calls to be sure. The last two handsets (I had 3 to 4 FAULTY iphones!!) were delivered by 'some bloke' in a car, not an official delivery van type person. Both times I was out at the time and again, both times he left the new phone without taking the old one back!! This all dates back to last October and I remember hearing about some rule regarding unclaimed items legally becoming your own after X amount of time. Am I right?

Before anyone suggests I try speaking to 02, oh believe me I have tried several times and they don't seem to understand what the issue is! At the time I took ownership of the first Iphone apparently they were out of stock, the first phone that arrived only did so after I had a rather firm chat with a supervisor after the previous CS rep had promised me a phone. All seemed rather 'shifty' to me.

what you got to worry about? have you been charged for these phones? have you sold em yet lol do they still work? I do not see a problem if they sent em and say they aint when you try to return them then bonus aint it lol

They are sat in their boxes on the same shelf as the day they arrived! Granted I'm using one, but the other two are just sat doing nowt!

If you write (an old fashioned method I know) to the supplier with words to the effect: -

On (dates) a replacement phone was delivered and the faulty / extra phones were not collected by the courier for return to you. These goods are yours to collect. Under the legislation the Consumer Protection (Distance Selling) Regulations 2000 I can keep the goods as a gift. However, I am giving you the opportunity to arrange collection of the goods at your own expense within 14 days, after which I will consider the goods my property.
If they then fail to contact you to collect then they are yours to keep and do with what you will.

BTW people in cars delivering stuff is commonplace now. Catalogues have been doing this for years.

Sure, only thing only two came this way (same day deliveries) the others came next day via courier.
