Could i sue BT Broadband? and How?

Hi,

Does anyone know the law well enough for me to sue BT Broadband?

Here is my case at the moment:

Back in May / June 2009, are broadband started to drop out and was useless for online gaming / and most of the time browsing the web; after numerous phone calls, and engineers they have still failed to provide a working service for nearly a year.

We've registered several complaints and none of which they took note of and responded, which made it seem like a waist of time; so we wrote to the Manager in durham, who had BT send more engineers, and eventually fixed it.

Again 2 weeks down the line, it started playing up again; so we decided to change provider to Virgin Media.

Everything was going perfect, until BT terminated the broadband account on the wrong date ! it was week to early, so we called Virgin who we're very helpful and answered my questions without fail, they couldn't believe BT had done that and was sorry they couldn't do anything until the activation date given.

BT now expect us to pay a cancellation charge, for a non-existent service which they terminated a week early and was unstable for over a year.

It's been capped at like 125K of no reason what-so-ever, which was over kill for it when tried loading facebook... then given a few days and it's back at 2 Megabits; we used to get around 6 Megabits like my next door neighbor.

So for months of issues and terrible service, they gave us 2 months compensation which means we don't have to pay the broadband bill for these months, i still think this isn't enough for all the 8 months or more of issues and expect us to pay a cancellation fee of £100.

My View of customer service:
The customer service, was rude and belittling as if they thought you we're stupid when they don't actually think for them selves; reading from a script.

I'm a C# and internal networking expert, so i know nothing internal is wrong but they insist on sending homehubs, and running start and typing cmd just to get my router IP everytime; i already know it be they force you to do it as there script says so...

And i had a manager, who was constantly talking over me when i was trying to tell him something... I put the phone down in the end.

I hope someone knows how to draw the money, from these leeches.

You can contact the "Ombudsman", Theres a company I contacted that took my complaint with Sky Broadband and mailed them on my behalf, unfortunately I can't remember the name.

If you want my advice, you can't really "Sue" BT, unless you are very rich. At the end of the day they are a multi million pound company with Solicitors on hand 24 hours a day.

Your best option is to do what I did, Write a letter so its documented, E mail is just as efficiant, but dont ring them as you cant document what has been said.

Secondly, contact the ombudsman, if you search for companies that deal with complaints about consumer rights, you should find the place i found, if i find the letter they sent i will reply with the name.

once you have done that, thats all you can do, they will sort it for you


i dont know how good you are with wording letters, when i wrote to them i was very forward and aggressive and highlighted my rights as a customer, i also threatened them with media if it came down to it. i dont know if that got there attention or not, your case seems similar, so i suggest you should probably have to go down the same route.

Agreed, OTelO and send your letter to them and BT recorded. We've got a couple of our customers out of some nasty scrapes with BT via this method. One was guilted by the salesman into a 5 year contract and didn't sign any paperwork. When he "cancelled", they tried to charge £400 disconnection.
