Just to note:

TalkTalk and Opal Telecom have now officially demerged away from the Carphone Warehouse Group, that also includes AOL,One Tel,British Gas and Tiscali branded services in the UK

And it looks like the Government is tightening up RIPA, with RIPA soon to require that interception can only occur with customer consent that is "freely given, specific and informed".

Admittedly, the actual phrasing may change as they are just consulting at the moment, but the end of consultation is on 7th December.
Not unexpected, seeing as that is basically what the directive the act is based on says, but good anyway..

So does this mean than ANY use of DPI will be looked at ???

To give the consultant's answer - it depends....

If they use it for traffic analysis for shaping/management, probably not. If it is used to provide info for targeted marketing, probably yes.

Nope. Network management will remain legitimate use of DPI and remain exempted from RIPA's interception provisions.
