Is this allowed? Is it contradiction? Would the ASA allow it?

Right, here's the thing.

I'm currently arguing with some prat on MSN. He's saying he doesn't contradict ISP guidelines, and that this is allowed.

There it says there is no download limits, but on the website there is download limits.

http://www.quatacom.com/broadband.html

On all 3 packages.

Is this false advertising, and what would the ASA say?

Re: Is this allowed? Is it contradiction? Would the ASA allow it?

It looks like false advertising dosnt it, could just be a c**k up on their part, maybe they should be informed, and if after that the ad is still running then inform trading standards.

Dan.

Re: Is this allowed? Is it contradiction? Would the ASA allow it?

This is currently referred to the ASA. However its for companies that don't specify a limit but shroud it in an AUP.

I don't see how any ADSL company can guarantee a certain speed, and their website isn't exactly professional. Avoid like the plague.

Agreed, the website doesn't even render properly in Firefox, and flash with sound on a home page is imo a no-no

Re: Is this allowed? Is it contradiction? Would the ASA allow it?

They can't spell either... they spell guarantee 'guarentee' and they spell 'provide' with no 'provde'

If you're gonna try conning people, at least get the spelling right.

oh and they're hosting the site in the US and their info is privacy protected.... not what i'd expect from a UK Bband supplier.

What does 'with no need to pay BT line rental mean'?

Is the price they quote inclusive of line rental?

Re: Is this allowed? Is it contradiction? Would the ASA allow it?

Oh, I know to avoid. The owner of it is a teenager believe it or not, or could you tell? The advertising isn't a mistake on they side, they were telling me there's an offer with no download limit. It's not there though? Also the website is crap, and they've probably got no customers because on the website it says it opened in late 2006, yet the domain was registered on 31/10/07... I think that means they got about 30k customers in 2 days according to the site?

The owner is a **** anyway, he says he knows a lot about this stuff. He obviously doesn't read what VM and Sky get in trouble for over advertising.

Given that its some teenager unless he's reselling for some other ISP I doubt he has any infrastructure to actually sell those services from anyway.

Unless he's a registered business I can't see wholesale providers wanting to offer him access to their network somehow

It's all B/S. He will be some teenager reselling broadband internet, you are right about that.

Re: Is this allowed? Is it contradiction? Would the ASA allow it?

All looks highly dodgy to me:

Template website
Only contact info is an 0870 number, no address
Lots of spelling mistakes
Dead links on homepage
A copyright date two years in the future!?!?!
Claims of actual line speeds, but no mention of how they do it

Makes me very suspicious...
