Judges are actually pretty keen on keeping drug addicts out of jail, since it's likely to make them worse. Hence the 'last chances'. Of course, he's not gone inside for the drugs, but for non-compliance, which fairly obviously demonstrates deliberate contempt for justice rather than being, like drug addiction, the manifestation of a disease. To my mind that's worth a custodial sentence.
Jails are full of drugs, but not full of ways to get off drugs. In Doherty's case, however, he's much richer than 'normal' addicts, so the usual rules don't necessarily apply (he's unlikely to be going out thieving to buy heroin any more, for instance, but is clearly in a situation to pay for the best help money can buy if he decided to). I don't think going inside will help him.
