Neither of them are blowing trumpets about HD platforms though - hence my earlier comments about the bandwidth requirements for HD vs the minimum requirements claimed for PlayTV.

The site also only promises to deliver content - it makes no claims or remarks about the viewing quality of the audio or video output you see. If they were being difficult, you'd struggle to legally stop paying because of crap picture quality because they never promised good quality.

And sueing them for defamation would fail to. You will have agreed to pay them to deliver a picture, of unagreed quality, which they will still be doing. They would be more within their rights to sue you for breach of contract than you would to sue them.
