This is complete rubbish. I use my connection for online gaming, hosting my email server, downloading and web browsing and have not been shaped at all. If you were "hardly using your connection" you wouldn't be shaped will you?
The thing you don't understand is that broadband in this country has an AVERAGE speed of 2 mbps. You, after being shaped are still above the average by 3 meg!
It is designed for people like you who, due to your excessive bandwidth usage, should be on a business line, and speeds up the net for those of us who don't take everything for granted.
None of your post above rings true for me, I think you are talking twaddle and need to get off your high horse.
If people like you didn't take the p*ss out of VM and hammer their connection day and night traffic shaping will not have been enabled on the network. You have yourself to blame at the end of the day.
As for Virgin not telling you about being shaped, have you read the T&C's? Even the "unlimited" connection mentions the fair use policy, and now they even have the traffic shaping terms on the website too, so you can't say you've been mis-informed.
Me? I couldn't give a monkeys about traffic shaping, it won't affect me but if I were to go over 3 gig then it's still a fast, reliable connection, so I'm not fussed.

Firstly, it is still an unlimited connection. It is just speed cut for a few hours after you've been naughty.
Secondly, as I've already pointed out twice in this thread:
