A customer can cancel the contract anytime they like for whatever reason they like
But they are liable for the EDF if they cancel in the minimum term

You know exactly what I meant
If the reason he went for a service was because of what it could offer him but then circumstances meant VM could no longer offer that service (and were not likely to be able to improve on it anytime soon) then I'm convinced that would be enough to allow him out of the contract without penalty, although there might be some discretion needed.

If it was Virgin's fault that the service couldn't offered e.g. there a a major cable break that cut of the existing service and Virgin wouldn't fix it - then they would cancel the contract.
However someone moving is not their fault.

Russ I wasn't missing the point.. Instead pointing out that sometimes a choice like that doesn't come into it.. If there isn't an alternative then the speed drop is irrelavant as everyone else can only offer the slower speeds. If VM was making him pay the £50 fee as a cancellation fee (or for a 2Mb ADSL service) then yes it would be wrong.. As was said in the first few posts VM hasn't made him move, just the same as VM didn't make him sign a 12 month contract which specified a cancellation clause (both were the OP's decision )

No I don't think you're right there. If VM cannot provide the service someone needs then I'm pretty sure there'd be scope for release from the contract.

It's a risk that every subscriber to VM takes and as such is not a reason for cancellation based on non-supplying of services.. I'd though still like to know where the OP is moving to as to VM not being able to provide any service

If the OP wants to argue over the EDF with VM after the fact they are more than welcome to do so.
However the frontline teams have no leeway in the EDFs. If they don't charge them they are not doing their job

Yep your right in that there is scope for discretion and it sometimes does happen but it's not a right and still isn't a reason for getting out of the contract
