contract help me

hello well im new to this site but i wanted to ask some advice, i was with ntl in tamworth was moving to birmingham, phoned them up to see if i could take my services with me, they said they cant because they dont run it there, so i asked about my 12 month contract on my broadband/tv and they said because they could not provide me with it in brum that the contract was void, fine by me.
now here is the problem, i then when i moved to b'ham i had telewest installed, but due to circumstances after 2 weeks i moved back to tamworth, i phoned telewest to cancel and that was last i heard, this was last june, i recieved a letter from wescott debt collecters the other day saying i owe telewest £366 and have 14 days to pay or go to court, well first off i never got any letters about this first, and i never signed a contract, and thought i could cancel and means they cant provide the service in tamworth i thought the same applied that the contract was void, so what do i do, im not paying £366 for two weeks of cable, any idea's on what telewests policy is on moving houses, and isn't there a limited time in which you can cancel, i would rather go to court, because i dont owe this money, can anyone help me or tell me what i should do.

Dont believe there is anything you can do mate. Telewest will uphold the charges.

Once telewest install services into your property a 12 month contract applys. Even if you havent signed a contract. Telewest do have a cooling period of 7 days but this must be canceled before install.

If you move out of area for whatever reason they will hold you to your 12 month contract, this has been effective since January 2004. They used to operate a system similar to nl where if you were moving and could not take the service you contract would be terminated but the new terms and conditions changed this. So i hate to be the bearer of bad news but i think this would stand.

IMO That's a very dodgy contract then, you sign up for 12 months service, but only get 6 months as you move out to a non-serviced area, they are no longer providing a servcie hence they have breached the contract. Not you signed to pay us for 12 months regardless of what you actually get from us.

Go to court if that's how you want to go. If you do, make sure you take all the records about this that you have and also contact telewest under the DPA and request ALL the information that have on you and your account. May cost you £10 but then you'll hopefully be able to prove that your not at fault.(well not completely at fault as you did agree to them installingh the stuff in the first place.)
