I don't think that's the case. They're still producing updated firmware for them, they're not illegal and they don't invalidate nintendo's warranty.

the latest proper R4 firmware is 1.18 I think the new R4's run on 1.23+

Am I making assumptions here. Is it the same organisation that makes the R4DS and the new R4SDCH.
I thought the new one was just an improved version that supported micro SD cards with more memory?

I think thats why they are all clones or fakes as the actual company no longer makes them.
The R4SDHC is made by someone else I think.

The only card to be aware of afaik is the N5. However the N5 has in some cases been cloned to look and act like a R4 . Memortybits have sold a barrowload and I see no issue raised on the site. I myself have had upward or 10 off them and no one I know with these cards are yet to have an issue except me. I have a new R4 stuck in my DS. It comes out far enough to remove the memory card so I can change the games but that is it. I do however feel this is a issue with the DS spring clip jobbie and not the card itself

What's the compatibility like on these cards?
Do they have problems with certain games, or should they play just about anything?

Back home so I can compare. They are both almost identically package in every way. The only difference between the original and the R4SDHC is the there is a small yellow "New" picture on the packaging. The new one needs different firmware downloaded so I'm wondering if this has caused some confusion. If this is supposed to be a different organisation I suspect the original people must have some input.
If there is any threat of litigation against the original R4 what can the grounds be. I've never seen any claims on there site, or manuals that they can be used for anything illegal. Has any one heard of a threat of litigation against other card manufacturers?

look at the barcode you will find its the same that would have changed these boxes are just copies of the original. If you look closely the centre is slightly different

 I have found your true identity Sherlock and I claim my 50 groats.
Both the new ones I've got work fine. Am I correct in saying though that these "clones" aren't really clones since they're an improvement on the R4DS. I thought the original were restricted to 4GB microSD whereas the new ones can access 8GB?

I was going to buy one for the misses, but just got confused.
The way I read it, the makers of the R4 got sued and stopped making it. Hence the new R4's (made by a different company - which uses different firmware compared to f/w the offical site uploads) so updating them sounded like a right pain.
Other cards need some kind of loading software installed for each type of game and the last bit I read was newer games can detect these cards and wont load.
My PSP is so much easier then all that.
