eBay help

Hi,

I won a bid on eBay for some BMW Car Mats, and they was listed as Genuine BMW. However they are not Genuine BMW Car Mats.

On the listing under Return policy it has:
The seller will not accept returns for this item.

Where do I stand, as they are not any good, as I wanted Genuine.

Contact the seller first of all and explain your situation and that you want genuine mats or a refund. If he/she does not co-operate then you can report the seller to ebay and they will open a dispute which will attemp to deal with it.

If that fails it will be left in Ebays hand to decide what to do but dont expect anything fast from them unless they have become alot better in the last year or so.

Assuming you paid with Paypal, open a Paypal dispute. Don't bother with eBay.

Contact the sellers as described and if they will not accept the return (at their cost) or a genuine replacement then explain (politely) that you will open a Paypal dispute and leave them negative eBay feedback. Give them a period of time to respond - say 7 days (make sure you don't wait till more than 45 days from the date of payment though or it's too late).

Always contact them using the "contact seller" option in the listing - that way all the mails are logged through eBay in case of any problems....

If you don't get it sorted, open a Paypal dispute (login to your Paypal account and go to Resolution Centre) - it costs nothing.

Open a new dispute, saying the item is not as described.

Paypal then contact the seller saying a dispute has been opened and give them 7 days to respond. If they don't answer within 7 days, they find in your favour and you automatically get a full refund through Paypal. Usually the seller will make you some kind of offer - you can either choose to accept it or "escalate" the dispute to a claim.

It's highly unlikely that, assuming the listing states they are genuine mats and they are not, that Paypal will do anything other than find in your favour. If the seller does not offer to pay the return postage either, you don't have to return them.

If it's a genuine mistake on their part then fair enough - if you feel they've deliberately mislead you and they are selling / have sold other similar fake items, report them to eBay for selling conterfeit stuff. eBay are quite strict on that kind of thing and will act. In those circumstances, it's also worth leaving negative feedback on eBay to warn other customers.

One more thing I thought of.

If you're posting it back, do it recorded delivery so that the seller can't claim they never got it.

If you bought through ebay it does not matter if you paid with paypal or not they will tell you to go through Ebays system first. Unless they have changed their policy as this is what I was told by paypal and had to do when I had a problem.

Have a read of the link the Rob posted - it explains it all, but, to quote from the page:

"If you can't work things out directly with the seller, you can open a case at eBay's Resolution Centre. If you paid with PayPal, you'll file a claim at the PayPal Resolution Centre."

If you pay by Paypal you always raise the dispute with them and as far as I am aware, always have. They do ask you to contact the seller first to try and get a resolution (but you don't have to) and you don't raise anything dispute wise through eBay.

Obviously if you don't pay with Paypal then you can't use them to complain and you would have to take it up with eBay directly but, as you said in your original post, they can't do much other than give the seller a warning.

I tried this but paypal told me they wouldn't do anything untill it had gone through Ebays system. I was P'd at the time myself because I tought whats the bloody point in the paypal system to protect me if they just refer me elsewere. Anyway it got sorted through ebay in the end. This was over a year ago though so it may have changed since then. (more likely paypal were trying to fob me off)

I would always want to go through paypal myself as Ebay take or at least used to 15% or something for administration fee's. Dont know why paypal refered me but thats what happened and thats all I was trying to say.

Thats great. Sometimes thats all it takes. A little friendly word with the seller. Unfortunatly thats not always the case but still seems you got the best outcome you wished for

I will not use Paypal..if anyone insists I do I won't buy from them.

I prefer the more traditional methods available like a CC or for sums less than £25, a cheque.

A year ago I would have disagreed with that, not now though.

Instead of Ebay first charging listing fees, then taking more of you with final value fees, and then even more off you with Paypal fees (paypal is owned by ebay iirc) they should have 1 flat fee depending on the item being listed, and this should include paypal fees aswell.

My brother had a car on ebay, didn't sell so relisted and somebody bought it, however they did not pay, are uncontactable and now he is stuck with paying ebay fees of nearly £50. He did ring ebay and mr singh in bangladesh said basically it's tough luck, pay me.

Most of the time ebay is ok but it is now all in favour of the buyers with stupid rules, sellers are fedup. Would you believe I had a listing removed for including the words *As New* in an item description?

F'in unbelievable.
