No i wouldn't!! lol....

I am putting myself in the sellers shoes......if i made the mistake of sending an item not paid for, i'd request the money and explain what i did, but i wouldn't hold my breath for it... and i wouldn't go crying theft. It would be my fault, and like i said, i'd write it off as a mistake not to make again.

Seems my opinion is rather controversial

Well more fool them, there's no such thing as trust as far as strangers and money goes. It states in ebay's buying guides that you pay THEN they send out the item.

I'm not saying he shouldn't pay, i'm just saying that he's not a "common thief" or whatever you all preached.

If you have an invoice or notice to pay, pay it.
You don't want to end up being taken to the small claims court and have it affect your credit rating.
