Debt Collection

I had canceled my fitness first membership a few months ago before the contract had finished, i told them in person and the woman agreed to cancel it.

But now im receiving letters from the debt collection agency saying they may put my name on the register of country court judgement if they make a claim in a county court.

The balance is £239.20, what can they actually do or are these just baseless threats?

Re: Dept Collection

I bet the official documentation states that any cancellations should be put in writing and there may be an early-termination fee. Any verbal agreement will probably be null and void.

BTW - Passing mod wish to spell check the subject ?

Re: Debt Collection

Gyms memberships are notoriously hard to get out of, I read about it all the time on moneysavingexpert.com forum. You should post it on there really.

Unless you are happy about having your credit rating knackered for the next 6 years as a default will be issued (if not already), you need to pay it off pronto

And yes, they can take you to court with a view to issuing you with a CCJ.

They add their own charges on for sending you letters and attempting to call you (even if they haven't!), so you've had a lucky escape.

Let this be a lesson to you, I'm 33 with a knackered credit rating due to a broken marriage and being in debt over my head. Save up before you buy anything

They can not just put your name on the register it does not work like that. Judgement has to be made against you.

First thing you should always do is demand written evidence that thay have rights to collect this debt. If they can not or will not supply this information blank em

Also do you have any sort of access to equifax or experian? My credit card gives me reports of changes to my file. If they have not done anything to your file they most likely would never take you to court

well fitness first said they will contact C.A.R.S and cancel it with them. So fitness first lied?
By the way, they have done nothing to my file so far.

I wouldnt have made an agreement with them until I had it in writing saying the dca were going to be called off. I do not trust any debt collection service

Things like this are the main reason I don't pay a monthly membership to a gym...

You need to ask them to send it in writing (via letter or email)!!!
