Debt Collectors right to take Legal Action
Hi, I have just joined this group, can anyone please tell me if a debt collection agency who claims to have bought a number of your debts, then lump 3 different accounts into one county court claim form, made in their own name only?
They say they are legal assignees for all three accounts but then say they are not obligated to respond to Consumer Credit Agreement requests, their only proof of ownership is copies of their headed letters to me saying they bought the debts, all sounds very dodgy.
This claim was issued 2 years ago and was then stayed because they failed to file a response to my defence, then out of the blue they applied to have the stay lifted and the court granted it, I am now trying to have that order set aside and the claim struck out for their long delays and failing to follow proper court procedure, the court have ordered me to show prejudice I have suffered due to the claimants conduct before they decide, any suggestions would be greatly appreciated.
