From HERE
Looks like your policeman was a bit keen.
Having said that he wouldn't have known you were the only driver,so, having told him that you were the only driver did he let it lie?

Re: stopped by old bill
don't worry your safe ,as with my van it is classed as a private vehicle not a company vehicle becauase you are the owner and sole user
Rules and exemptions
The new regulations prohibit smoking in all enclosed public spaces. Company vehicles are to be treated as ‘work places’ if they are used by more than one employee. The following rules apply:
. - Employees who have a company vehicle for their sole use may not smoke while carrying colleagues for work purposes
- Employees who have a company vehicle for their sole use may smoke while carrying colleagues to and from a place of work, as these journeys are counted as private use
- Drivers are not allowed to smoke in a company vehicle if it is used by more than one employee, for example pool cars, as there is a risk that other colleagues might later inhale their smoke
- Employees sharing a pool car are not allowed to smoke in the vehicle, even if all the users of the vehicle are heavy smokers
- A shared company vehicle is exempt from the smoking ban if it is a convertible, but only when the roof is down

Re: stopped by old bill
actually you may have an arguement if the vehicle is only ever used by you and you alone
Quote:
SMOKEFREE VEHICLES
The new law will require vehicles to be smokefree at all times if they are used:- to transport members of the public
- in the course of paid or voluntary work by more than one person – regardless of whether they are in the vehicle at the same time.
Smokefree vehicles will need to display a nosmoking sign in each compartment of the vehicle in which people can be carried. This must show the international nosmoking symbol no smaller than 70mm in diameter
When carrying persons, smokefree vehicles with a roof that can be stowed or removed will not be required to be smokefree when the roof is completely removed or stowed.
Vehicles that are used primarily for private purposes will not be required to be smokefree.
Ships and waterborne vessels will be covered by specific regulations that are being considered by the Department for Transport. More information is available from the Department for Transport by emailing smokingonships@dft.gsi.gov.uk or calling 020 7944 5427.]

Possibly. Although the Police don't need a reason to stop a vehicle. If its moving on a road its fair game.

In fairness it can be hard to judge a private van from a company van .My van has no signwriting on it at all ,i have been stopped by the cops about 4 times for smoking and all occasions they apologized and told me be on my way .If i had a passenger it would be different though as that would then include it in the smoking ban unless it wasn't being used for private use like shopping at the supermarket
