Another speeding thread

Should I incriminate myself?

Our company pool car was clocked at 42 in a 30 zone, within 300 yards of the 40 becoming a 30 I might add.

Now the company has loose procedures for booking the car and the photo provided by police shows the back of the car with no clear evidence as to who was to driving.

Given there seems to be medium sized industry getting people off camera offences is it appropriate to incriminate oneself?

I'ld only admit guilt if I was guilty and they asked me if I was driving.

My last job you had to book the car in advance, and if the pool car wasn't free they would get a hire car in.

Every thing was recorded, who would be driving and the passengers.

Pay no attention to the self-righteous anti-car brigade who will post here saying "if you can't do the time, don't do the crime". This is down to you and you only.

Do YOU wish to be punished for speeding. That's all you need to ask yourself. You getting the point and fine is very unlikely to affect the way you drive in future. If you feel taking the rap will benefit you then that's your decision made.

I've noticed your location and was wondering out of interest if this was in the Runcorn area near to the bridge? I know it well if thats the case and it goes 50-40-30-40-50 within about a mile and is well known for income generation

I guess it depends if it's possible that someone else will be blamed and get the fine/points. If it's a case of no culprit then no blame, it's up to you, but if someone else was likely to get blamed, I'd own up.

The NIP is sent to the company, it's upto the company to specify who was driving.. In this case unless the company gives the police your name then you don;t have to do anything. If though they say that you were driving and you deny that claim to the police then you are breaking the law (again)

As for Russ's comment on anti-car drivers the comment I normally use is if someone does speed, then expect to be caught and they only have themselves to blame, no-one else makes them go faster than the speed limit and making an excuse for breaking a law is between them and the police/cps

Doesn't the law say

If the owner cannot identify the driver then the owner gets 3 points for failing to identify driver instead of the 3 points or whatever for speeding, so either way somebody gets points.

And we all know what points make.....prizes

Pretty much. The owner is responsible for knowing who is driving the car at the time. If they can't provide a good reason for not knowing then they get the points and fine.

Not so ,how come the Hamiltons could not remember who was driving their car on the day it was caught speeding and got off scot free !

So.

It's up to the courts to decide what is and isn't a reasonable excuse. Plenty of people get done for it each year.

Anyway back to the matter in hand this site has information on Section 172 and a specific section on 'pool cars'

No, I think I fall into the category of soft target ! I dont want to cause excessive trouble for my employer and deep down I know what is the right thing to do. It annoys me when those with serious cash can get off scott free on technicality due to a clever (sharp) brief. Not withstanding the inability to provide evidence I am not sure the road signage is upto scratch etc.

In response to Superbiatch it was not in Runcorn, but actually in Warrington. For those who know Warrington it was on Cromwell Avenue, which links Winwick Road, and Liverpool Road. Both of which are 40mph zones but Cromwell is a 30 zone. I was annoyingly within 300 yards of a 40 zone ......

Anyway, thanks to all for the contributions, there is some usefull info here that will help me tighten up our procedures for use of company vehicles.

Lets hope its no more than a three pointer........
