Debt Advice.
It's not for me it's for the missus, when she left her partner 5 years ago she paid the final instalment on the mortgage for her time being there then he was in charge of paying the mortgage. He was off work but claiming the insurance for the mortgage but not passing it on to the company, his mother was also giving him £300 per month to cover the mortgage so in all he was getting £600 per month and not paying a penny. Anyway the house got repossessed by the mortgage company a year later, he didn't go to court my missus was the only one there. The mortgage company asked her if she wanted to rent the house but she said no there's to many bad memories.
Yesterday the missus got a letter from Direct Legal and Collections regarding the arrears that was left on the mortgage a sum of £5,860 which is climbing everyday with added interest, she phoned them up and explained to them what went off but were wanting none of it all they were bothered about was the money and if she was going to pay it? They have only contacted my missus and not him, she has given them his address but he's on the sick because he's a drug addict and a alcoholic so I can't see them getting anything off him.
In all up to now she's paid off nearly £8,000 of his debts which he ran up after forging her signature on car loans, bank loans, re mortgaging the property etc etc.
She recently had a letter from the Child Tax people telling her she'd been overpaid by £6,000 from 5 years ago, it turned out her ex didn't declare everything to them regarding his earnings, they are looking at taking her to court to recover the £6,000.
All in all they are chasing her for over £12,000 add the £8,000 on top and you have a tidy penny he's run up. There's no doubt he'll get away without paying a penny while the missus has to pay all the debts that he ran up.
It's not bad for a woman who suffered 13 years of domestic violence is it??
How does she go about getting it wiped or paying a minimum payment to them each month?

Contact the CAB before you even speak to DLC.
The child tax credit will have to be paid back I suspect by whoever received the money. Speak to the CAB is all I can say as they'll know more.
Plus if he's been forging her signature isn't that fraud which should have been reported to the Police.

Forgive me if I am wrong, which I most likely am. But Arrears is missed mortgage payments + additional interest on that amount. When they repossessed the house they cannot claim total ownership of it because payments would have been made and thus she would have had some equity?
The equity would have meant paying off the interest and the value of the house repossessed covering the rest with some cash left over? In otherwords the bank would have taken the money owed and had to give any reminder to the former owners? Do banks just claim all of it regardless of the equity you own?

Hi Nidge, I have read your article with sadness, BUT the one thing l would say is, tell your wife not to stressed about it, Also to start off with, the major problem would be, if your wife's name is on the contract as well for the mortgage, still don't get stressed about it, call CAB and get good legal advise about it.
The 'worst' part of this is the debt recovery people, they are w++++++, and they will try to make your life hell, they will soft talk you, and keep on trying to get money out of your. DON'T. I have dealt with more D.R.C people, than l have hot dinners.
They are not allowed to harrasse you in anyway - its illegal.
BUT l strongly advise you to get legal rep behind you, as soon as possible, as they will help you through everything. Good luck.

Nidge, when she split from her former partner, why did she not have her name removed from the mortgage deeds?
If he has forged her signature, she should really have gone to the police. What proof has she got that he forged her signature? How can he have forged her signature on a re-mortgage form? The signature must be witnessed on the deeds transfer.
At the end of the day, these debts are his, but as she seems to have not taken steps to separate herself from him financially, she may also be jointly liable, irrespective of her status now.
