Re: Debt Collection Agency
Well i asked them to send me out a letter which will conform the £260 deal, and i also recorded her saying the repayment is £260. She said they would send it out on Monday in writing.
@Mr Angry yes i do understand her post, but its just that i don't have much time to deal with all this i have so much to do and i don't really care whether or not they have legal papers that they can request any money from me, as long as i am able to pay as little as possible and get it out of the way in the easiest pay possible im happy with that.
I know it sounds stupid, but i have a lot of stress in my life and its just easier to deal with it like this.

Zee,
If you think you've a lot of stress in your life now just wait until you figure out that every debt collection agency in the country now knows that you roll over on the "say so" of a third party.

Re: Debt Collection Agency
I wonder how long it'll be before WESCOT sell on the remaining £935 remaining on this debt to another agency Remember they're not writing off the debt, that got done by the original company they're just getting as much out of you as they can before they themselves give up as well..
I currently have debt (£18 to Orange) and I've not paid it back as I'm in dispute as to the when the contract ended, it's amazing how many letters I get per week from 6 different debt recovery people even though they have no right to as the debt is in dispute..
NEVER, EVER believe what a debt collection agency tells you

Thats not the only debt i got, i have £60,000 debt to pay on a mortgage, then i have £3500 university bill which i have to pay myself. then i got £2000 RBS debt, plus my credit card and other minor debts, not including the monthly bills i pay for everything else. Which is why i said i have a lot of stress and i want this one to be over as quickly and easily as possible.

I don't think you are alone there Zee (in fact I know you're not!), but I think what people are trying to advise you to do is to do it the right way. The way I see if you'll still have the same debt, its just getting shifted - another debt collection agency will be chasing you for the same amount?
Seek advice from the CAB, get them to negotiate with your creditors and get yourself straight.

Sorry you don;t seem to be getting the point..
The DEBT with O2 is already written off, as such it's been entered on your credit report and no matter how much you pay to WESCOT that will NOT be removed.
WESCOT has purely bought the right to persue the debt (as I said in a previous post they will have paid a nominal amount to O2 for this right) and any money they recieve goes directly to WESCOT and not to O2
All WESCOT can offer is not to chase up the debt themselves.. but they can not write off the amount as it's not theirs to write off.
The £260 paid will have one effect, and that is to stop the letters from WESCOT so please stop seeing this company as the creditors..

Re: Debt Collection Agency
As Kymmy says, you are not "getting it".
Wescot, based on their business model, have in all probability "future purchased" the debt as part of a bulk debt purchase from O2 who had already written it off.
Up until you made your payment by card you / Wescot had no legal relationship nor was there any debt acknowledged.
This is why I advised you to ask them to provide you with a copy of the deed of assignment from O2 before proceeding beyond acknowledging their letter. If they do not have one, which you can be 99.9% sure they don't, then they have no legal right to purport to collect a debt of behalf of O2.
However, this is all academic now that you've made a payment.
Unfortunately things will unfold pretty much as Kymmy has described.

Re: Debt Collection Agency
The most rediculous thing here is that when another agency start chasing this debt it'll probably be a partner company to WESCOT and because the company is owned by the same umbrella company and your non-chase agreement is with WESCOT they can quite legally do it.. As they'll know exactly how much you've paid WESCOT they'll then know how much they think they can fleece out of you
As I said a lot earlier once companies start taking responsibility for thier own debtors and the credit they hand out to such people the sooner these debt collecting scams will be a thing of the past

First thing I would do is as others have said, go to the CAB and ask for advise...
BUT the only way of removing this debt if you can't pay the full amount is to go bankrupt (You will though still have to pay a reasonable amount to O2 but the debt will be cleared) BUT the bankruptcy will follow you on your credit report. It's not a decision to take lightly.
In the future advice to everyone is NEVER EVER speak to debt recovery agencies, instead speak to the original creditors and try to arrange via them the best course of action. If you can't follow thier payment plans then the above mentioned bankruptcy is the only way out to clear the debt..

Re: Debt Collection Agency
The choice is yours, pay them off and have your credit report say late payer, or don't pay and have the credit report say defaulter. O2 isn;t gonna chase the debt only those that think they can make money from you and this is what myself and Mr. Angry have been trying to make clear to you. Paying the wrong person can be worse than not paying anyone at all
