Speeding Ticket On Provisional License
Intended Prosecution Speed Limit?
Hi !
I am holding the Non EU License from 15 years.
I have stayed in uk from last 14 months.
I got the letter saying Intended Prosecution where it states ,I have exceeded the speed limit to 37 in the 30 mph zone.
I also have the Provisional UK driving License.
Can some body guide me the further steps I should follow.?
I have following queries.
1)Should I mention the Non EU Driving License number at the back of the form and send it across.
2)Should I call up the number mentioned on the Form and try to know the details if they can consider my international License or the matter can be closed over phone and giving details for payment .
3)my insurance is on international License and not on provisonal one.
Should I change it now on the Provisional one before sending the form
4)Can any body also guide as to what is going to be the exact procedure now and time limits for each one from law.
Please guide if this matter can be closed in clean manner.
regards,

Re: Speeding Ticket On Provisional License
You were driving without a full licence that is valid in the UK?

Re: Speeding Ticket On Provisional License
I may be completely wrong, But because you have been in the UK so long, you would have needed a FULL driving licence, not a provisional.

Re: Speeding Ticket On Provisional License
Yep, IIRC you can only drive for so long on a foreign one, and that depends on the country of origin. Why have you not bothered to sit a UK test after all these years ?

Re: Speeding Ticket On Provisional License
So you should NOT have been driving then!!!!!!
There is a case you could also be prosecuted for 'Driving other than in accordance with a licence'
And I am sure a condition of your insurance will be you have a full driving licence

However, if you do not pass a test within the 12-month concessionary period you will not be allowed to drive as a full licence holder and provisional licence conditions will apply. If you do not apply for a provisional licence within the first 12 months you must stop driving and obtain a British provisional licence with a view to passing a driving test. Provisional licence conditions will then apply.

Re: Speeding Ticket On Provisional License
Foreign nationals can drive on a non-recognised licence for 12 months, during which time you were supposed to take and pass the UK driving test to gain a full UK licence. If you were driving with a driver holding a full UK licence then that's ok, but if you were on your own you were breaking the law twice, speeding and driving without a licence. Presumably, you would also be found to be uninsured too as I'm sure your insurance would be invalid in this case too.

Re: Speeding Ticket On Provisional License
Unless you were in accordance with your Provisional licence (i.e. accompanied by a full licence holder) then you are also likely to be done for other offences, You'll have to admit to your non-eu licence though I doubt if they'll ask any other details as to your length of stay in the UK (that normally gets done at the roadside and I take it this is a camera fine) then you might be OK... BUT if your provisional (and they will find it on thier system whichever way you go) is more than a year old then they might come down on you like a ton of bricks)
My advice is if you're gonna drive at all in the UK get a full UK licence as currently they can do you for Driving not in accordance with your licence and No Insurance (as your licence isn't valid) which both together is likely to get you banned and if you get banned on your UK licence then you can't use your non-eu licence either
My motto is if you can't take the penalty then don't break the law

Re: Speeding Ticket On Provisional License
What do you mean Russ, apart from the fact that it sounds like a how can I dodge type thing and the fact they haven't posted back.

Re: Speeding Ticket On Provisional License
So, in effect, you do not hold a full licence to drive in this country. Therefore, your insurance, is invalid.
Sounds familiar. The Police are currently snatching cars from such people, when stopped at the roadside.
Sounds like your trying to con your way out m8. Foreigners driving in Britain without a licence or insurance are certainly not helped to "get out of it". Uninsured drivers cost us millions.
Face the music, then take a test.

Agreed.
You'd have to wonder how the OP received a notice of intention to prosecute for just the speeding offence if they were only holding a provisional licence.
Very bizarre.

Re: Speeding Ticket On Provisional License
NIP goes to the registered keeper of the car, not the licence. You don;t actually need to hold a licence to have a car registered in your name, but you are then very likely to be pulled over every time you pass an ANPR camera
