Speeding Prosecution
Can any of you guys tell me what the penalty will be for the following:
My son aged 26 has ben prosecuted abd due to appear in court after being caught by police doing 108mph on A14 (dual carriageway with limit of 70mph)
He has a 3 point statutary fine already on his licence. Will he be offered option of 6 points or ban. How long would ban be for. He needs car for work as he works 80 miles from home.
Any help or advice on plea or anything else would be appreciated. For the record as his father I am disgusted and have no time for him, I am just worried for his job.

Re: Speeding Prosecution
Its normally a ban on anything over 100, I appreciate that he needs his car for work but he took that risk when he broke the speed limit by that much. As for ban length and fine (quite likely) I believe that is fairly arbitrary and depends on the judge.

Re: Speeding Prosecution
It's possible he might escape a ban if he can prove he'd lose his job over it and the judge is feeling generous, but I think Graham M is right - a ban is quite likely at the moment.
How long ago was the offence that triggered the first 3 points? If that was recent then I think a ban may be more likely.

12 months ago. He has no dependents as he still lives at home with parents albeit at weekends only.

Re: Speeding Prosecution
Why not look in the local newspaper, they are full of details of motoring offences in the appropriate section. Looking into it locally may give you an idea of the length of the ban.
I'm afraid that although it varies it'll pretty much be a ban for a few months and fine at the least.

Re: Speeding Prosecution
Hate to hijack the thread, but after reading the local paper 30% (or something like that) of drivers caught speeding where unable to be prosecuted as the number plates where not registered with DVLA.
Moral of the story don’t bother registering your car.
Also after see Cops with Cameras, drive a car with a provisional licence no insurance get caught and get………………†¦â€¦â€¦..wait for it,
£150 fine and 6 points!!!!!!
Well worth the risk!
Good luck caveman and I hope the penalty is not to harsh.

Re: Speeding Prosecution
You've just got to hope that he learns from this, if your location is true Cavey you are more than aware of the number of idiots on the road in this area that think nothing of doing silly speeds on certain roads
If he's lucky the judge will take his employment into account especially in the current financial circumstances.

Re: Speeding Prosecution
Anyone know. If you get a ban, say 2 months. Can / do you also pick up 6 points as well. i ask this because if he then picked up 3 points in 2 years time he would get banned again on the tottin up to 12 points rule.

Surely it depends what the judge says. He could get 6pts. He could get points and a couple of weeks ban or months. Technically your son could be made to retake his driving test after the ban expires. It's all upto the judge. Essentially I think the answer is yes and they'll be on there for 3 years, allowed to be removed later and declaration to insurance companies etc after the 3 years.

As a rule (general guideline rather), no: the disqualification is imposed in lieu of penalty points. The judge may however take a more dim view if the defendent is a persistent offender.

I suggest that your local paper is talking complete and utter drivel (Although, which papers don't) as ANPR stops this happening
