Eviction
There's a guy who lives in a flat next door to me who's been evicted today, he was supposed to be out by 5pm last night, the reason for him being evicted is due to him owing the landlord £750 in back rent, he's been giving him bounced cheques as rent payment but they've been no good, the landlord has had to carry the costs of the bounced cheques.
On the 1st of January the landlord served him with his notice, his date was the 29th of Feb, he's still here and made no attempt to move out, he was on the wine at 7.30am this morning and finished a bottle before 9am.
The Landlord is coming round later to hoof him out, he's phoned him loads of times today to tell him to move out at a certain time, the best thing about it is the landlord is a Policeman with Nottinghamshire Police and is not a small lad.   
Looks like it's going to kick off here later on.     I'll keep you posted on what happens.
Forgot to add this bit, the chaps car has no road tax, he SORND it last August but has been using it on a daily basis, he's also got no insurance on the car, shall I tell the landlord when he turns up??

Yeah tell the landlord - Unless be breaks the law and physically hoofs him out he will end up having to go to court and the bailiffs to secure an eviction. It will cost him a fortune

The landlord has just been on the phone asking me if he's still there? I told him yes. He said right he's trespassing as of now, he's finishing work then coming round with some spare keys then hoofing him out, me thinks it's going to be an interesting night. I was going to go out but I've changed my mind now

Unfortunatlely in these situations the legal route to gaining repossession is far too slow. Yes the tenant may be in breach, yes the court will grant an eviction order, but is just takes too long to get it to court, and costs too much. Even with an order to evict, if the tenant doesn't voluntarily leave, getting bailifs arranged and the like all adds more delay. Meanwhile the landlord looses on three counts: no rent from current tenant, outlay on the court proceedings, and no doubt more expense to reprepare the property when he does get possession.
Is it any wonder that landlords are likely to try ignoring the correct rules?

That's what he did at 10pm last night, 3 of them came round with new locks, the chap was in his room, they just walked in turfed him out then bagged all his stuff up and placed it neatly on the causeway in front of the building.
He's had the money to pay his rent, the landlord has done everything to help him because he's told the landlord so many lies about this that and the other the landlord believed him.
Anyway it's all sorted now he's gone and thats it.

It is now actually possible to 'fast track' a possession order - meaning that once a tenant has stayed past the end of their lease (whether it be natural ending of the lease or due to the eviction notice, you can get your property back in as little 2 weeks
However you still have to go through the whole hassle of waiting for them to be x months in arrears, obtain an eviction notice, and so on

hhmm.. well he'd better hope the guy doesn't know the law, because what he's done it illegal, and as a copper he should know better.
How did he serve notice? was it via the court, or did he just do it? - what kind of contract did he have.
Forcibly taking possession like that is (AFAIK) illegal.
We went through evicting someone (there's probably the thread about it floating around here somewhere) about 3.5 to 4 years ago - the tenants have all the rights, the landlords have none - rules that were bought in to protect tenants from bad landlords have meant that good landlords have no protection from bad tenants.
Once we had the eviction notice, we had to wait until he had gone past the date, before we could even book bailiffs to get him out - and that took a few weeks before they had an appointment
