Breaks when Working?
I've searched & read a few topics on the forum about this... Link to one Post here & Link to BusinessLink site here.
A freind of mine called today & works partime 8am till 4pm (he has a 30min break for lunch). But he has to REPAY the 2hrs time on another day. He used to have 10-15min mid morrning & 10-15min mid affternoon (no lunch). But now the carehome manager / warden has changed & he was told no breaks but as he works a 6+ hour shift he has to take 30min, but he also has to make this time back to them.
Any links or Advice?

What doesn't seem clear from looking at the various links provided, is whether the employee is entitled to be paid for the break time.
If Jedi's mate is being paid the full 8 hours per day, but then is expected to work unpaid for 2 hours to 'make up' the weekly break time, it would be the same as being paid for 7½ hours work in an 8 hour day which includes the 30 minute break?

Yeah thats whats hard to understand... Some places pay morrining break & not afternoon. So they give 50% you give 50%.

But if you work 6+ hrs then you have to stop for 20min (not paid?) before doing 2hrs left on a 8hr shift?

The only stipulation about when the break should be taken, is that it shouldn't be at the beginning or end of the working day/shift.
I'm salaried, rather than hourly paid, but my working day is 08.45 to 1700, with an unpaid hour for lunch, so I'm effectively only paid for 7¼ hours per day, rather then the 8¼ that I'm physically there.

hmm, pressured is probably too strong a word, but as I usually take my break at my desk (convenient for getting on the net), I feel obliged to answer my phone, etc.
On the other hand we are quite at liberty to leave the building during our lunch hour, it just isn't much of an option for me, as we are physically located in the Grimsby Docks estate & the nearest café serves great food, but you end up eating wedged between two huge blokes smelling of fish

Paid or unpaid breaks really comes into play when they work out your overtime hourly rate.
If you're at work for 40 hours but only get paid 35 of them (1hour unpaid lunch for instance) then your hourly rate is higher than if you work 40 hours and get paid 40 hours.
So if you're salaried, it's in the company's interest to claim that they're giving you paid breaks, so that when you work overtime they pay you less.

I work 14:00 until 22:00, at the moment, though there are some days when I work 12:00-22:00, 13:00-22:00, or maybe even 07:00-22:00. Does vary. I am not paid for the 30 minute lunch break I take, which is a bit of cheek because if I take the break during the day, I can guarantee someone will interupt me mid-sandwich bite with a question. And on an evening there are so few telephone calls, I tend to just nibble a packet of crisps at my desk, whilst staying available for calls, so no lunch as such. That does mean the company gets a lot of free work out of me, but welcome to capitalism. At the moment, they've banned hot drinks from being carried around, and removed the free facilities, so breaks are pointless too.

i generally work a 7 or 8 hour shift with 30mins unpaid break, however my food is provided so not a great loss, i do prefer to take my break within the last 3 hours of my shift so that i have less time to work when i get back
