Speed cameras flashing oncoming cars
I've joined because I saw a piece on this subject, and saw comments that indicated that if you are flashed by a Gatso front-on and where the crocodile teeth are on the other side of the road you would not receive NIP. Well we had exactly that happen and we HAVE received a NIP. So should I challenge it?

Many cameras now are forward looking, rather than rear facing.

Go back to the area and check if there are any speed camera warning signs on the side of the road you were flashed. If not challenge it
Although it might be worth while just paying up as a speeding offence challenge can take along time and can be costly.

Hey Harold Sim!
it was me that asked the same question just a few weeks ago.
Are there any markings on the opposite side of the road to the camera? i.e. the side you were driving on? If not - I fail to see how they could actually measure your speed as there is nothing to reference against.

Hi LSainsbury! No there definitely are not. It's one of those swingable cameras they use for small single-carriageway roads, so the markings are in different places depending on your direction. The markings applicable to the direction I was driving in are about 100 yards further along and not where the camera was looking. I agree with your comment, and can only think that it used the markings on the road for the other direction in some oblique way

Right - I'd ask for the photo evidence then. And the calibration certificate.

I got a NIP last week for doing 73mph in a 70mph limit. If you think that you were not speeding, ask the police for the ACPO Guidelines for that particular road. You should be allowed 10% plus 2 mph before the police can issue a NIP, UNLESS a order is in place for a speed restriction.

I'm just waiting for someone to challenge a murder charge as there weren't any signs up saying they might get punished if they break the law.
It amazes me people get so wound up by people being punished for breaking the law, the law is so much in favour of motorists it's not even funny. People can (and do) literally get away with drink driving if a very specific phrase isn't used during the procedure.
How anyone can think thats right is beyond me.

Unfortunately or fortunately, to enforce the law it's got to be done by the book. So as we all know if there are technicality's and it means you get off a conviction then that's just lucky. You can't convict someone on dodgy evidence or procedures.

Would you say there is a difference between the phrases "I arrest you" and "You are under arrest"?
Personally I think both are fairly clear but using one instead of the other could get someone off quite easily.
Procedures are there for a reason but when prosecutions fail for reasons where something has been done in good faith and someone gets off on the most minor thing I can't agree that is a good thing.
I would say there is a huge difference between dodgy evidence and doing something extremely minor wrong in a procedure.
