Have I broke the data protection act ?

I opened my big mouth before I thought.
What happened was, last week I went into work and one guy didnt turn in. I mentioned that I saw him in the forums (not this one, on another site) a couple of hours before he was due in work.
He reckons Ive broke the data protection act by saying this, is he correct ?

Erm that only applies to date stored electronically or physically as far as I know and does not apply to verbal information etc. Load of BS in my view

not really much more to add, I`m his supervisor, he didnt turn in, we ran down 1 less on the shift which is a pain, cause theres only 5 of us and he really let us down. He said he was sick in bed and I mentioned it to the rest of shift who gave him stick cause they all guessed that he`d been up most of the night on his pc and he was just tired.

I very much doubt it has anything to do with the data protection act at all.

Seeing him online is just like if you had seen him in the street.
It just may be a little harder to proove it was him if he is using an alias online or not using his full name, etc.

I often use my laptop in bed when im ill and when im sick for example in the night I tend to be awake so id surf. The guy may not have been throwing a sickie he may have been but just cuz he was seen on a forum doesnt mean he wasnt ill

On another note (i know its not this forum so you cant speak for them) he`s asked them to investigate and ban me for revealing this info.

You cannot be banned just for pointing out someone was online when he was supposed to be "sick". The bloke is an **** that thinks he knows more than he quite obviously does. I would laugh my knackers off if he asked me that.

Some people just use Data Protection as any excuse to hide behind, without knowing the ins and outs of the act. I've even had "because of Data Protection" as an excuse from companies, when a Data Protection officer advised to the contrary.

What data? all you've done is remarked on what YOU'D seen and (due to the fact) it was in his own time, what's his problem?

Anyway he doesn't come across as very intelligent by making a big issue over this - more like a response to a guilty conscience. Data protection act indeed - Load of Benghazi!!

i think he's protesting to much for someone with nothing to hide,probably chucked a sickie and got caught ,thems the breaks when you con people,and as for the data protection act bit ,utter waffle,and what forum would ban you for telling the truth.
