maplins
i bought a graphics card from maplins about a month ago , it appears as though it is going gaga on me , so i checked the receipt and it says refunds/exchanges within 14 days with receipt and packaging , now it is more than 14 days so what happens

The statement on the receipt doesn`t mean jack, you have rights under the Sales of Goods act that mean you can demand a replacement or refund within a period defined as a reasonable lifespan for the product.

you can see the results of my battle with Game to get a faulty XBox replaced under the Sales of Goods act, and the fact that if you make sure you do a little research and stand your ground you can force shops to recognise your legal rights.

Yeah, just read-up first of all, then walk into the shop and if they start messing you about, just ask to speak to the manager and then start spouting the Sale of Goods Act at him. You'll soon get it replaced, cause although the teenager at the till might not be aware of it, you can be sure their manager knows they're legally obliged to replace faulty goods

just rang them and they said it has to be sent away to their service centre and checked , if they cant find a fault then it is my problem  , dont seem right somehow

That's when you get Trading Standards on to the case. If you don`t get any joy with the store it would also be worth getting on the phone to the head office directly. You just need to stick to your guns and don`t let them give you any BS. The DTI website has loads of good information on this, so you should do what I did and queue up a number of their FAQs so if they do try to give you BS you'll have the answers at your immediate disposal.

The '14 day refund' policy is probably an 'over & above your statutory rights' one - i.e. where they'll refund even if they don't have to by law, such as if you just decide you don't want it even if there's nothing wrong with it.
Remember the Tesco's ad where Patricia Routledge got a refund on her fish as it didn't look happy enough? That wasn't under the Sale Of Goods Act !
Of course, you still get all the rights under the relevant legislation & manufacturers warranty if there is one.

I thought that once a product was at a certain age it had to be replaced by manufacturer.
Mind your contract is with maplin not the maker of the card, and thats what TS will tell you.
If Maplin want to send it away and test it let em, if they find no fault your card is OK, if they do you will get a working card.
Other option is to contact manufacturer of card and see what thye say. Their Tech support may help decide if its fooked
