Interesting article... In a way, I can see why the judge ruled the way he did, after all the teenager just sent a massive amount of emails and the Computer Misuse Act currently only covers cuasing unauthorised changes. I think, like you say, that the Computer Misuse Act will have to be revised to keep up-to-date with current forms of attack.

It is an interesting point, you could acidently overload or server by sending it too much work or being configured.

I am glad the judge ruled the way he did, but it is a shame in another way as it may have been a way of combatting the spam producers?

While DOS may not be illegal as such.. its more or less against every ISPs terms of service... hefty fines, disconnections and spankings ahoy!

This hasn't been 'declared legal'. The court has simply confirmed that it isn't a breach of the CMA.

I'm assuming that the prosecution was just brought under the wrong legislation.
