A prison sentence that should scare them !

I mentioned before that I know a young girl whi is going out with a piece of thieving pond life.

About 2 months ago he was caught stealing 'again' and went to court, he was saying in the pub that to his surprise he didn't get a prison sentence because of all hi previous. He was very annoyed that he was to pay £1200 for costs/fines etc and had to serve 180 hours community service.

He stated that he was not going to pay penny or do the community service because he would rather go to priso and get it over and done with. (He is a little work shy)

Anyway, put the clock 2 months forward and last Friday he appeared in court for failing to pay a penny or serve a single hour of his community service. The judge sentenced him last Friday to 60 days in prison and he was sent down. I hear the sensible amongst you thinking that that was quite fair that he should serve a sentence of 60 days for his failure to comply and utter contempt.

He went to prison on Friday, and his sentence had the first 18 days automatically struck off, and he was given a 50% reduction for good behaviour. I understand the struck off meant it was 'disregarded' or 'discounted'. (Not sure of the term that was used perhaps someone here knows what that means)

The result was that for a 60 day sentence he went to prison on the Frday and was out on the Monday, meaning he served 72 hours in prison for failing to pay his £1200 fine and not serving any of his 180 hour community service.

To make matters even more silly, he has now served his sentence for the original crime so the £1200 does not need to be paid and the 180 hours community service does not need to be served.

The judge and the justice system really showed him who's boss didn't they

I don't understand this, if he got 60 days minus 18 days, then a 50% reduction ie: half of 42 days that would have left 21 days. How on earth can he go in on a Friday and be released on the following Monday having served only three days?
Also I was under the impression that people like this "lovely fellow", who failed to pay their fines and where subsequently imprisoned still had the outstanding fine and in this case community service reinvoke upon release. Isn't the prison sentence for failure to pay his fine? not instead of.

One of the guys in work has a wife who is a solicitor, I mentioned it to him today and he didn't seem surprised. He just replied 'Thats fairly normal'

I'm afraid its just another story that I am unable to back up with a link to a newspaper or source that suits everyone around here.

I somehow doubt this is a one of instance, real stats would be ones that show individual sentences against actual days served not limited information released to to suit a particular party. If all these sort of stats were available niether side could manipulate an put their spin on it.

The fact that hesaid to me that he wanted the prison, indicated that he knew the original sentence would be wiped out. The system is very well known to him so I think he knew what he was doing.

I think he could be in credit with the law, meaning he will get away with his next two muggings and a shoplifting charge.

It seems a bloody travesty, I always thought the original fine still stood, so as to stop the likes of this toe-rag doing precisely this. I remember many moons ago going to Bow Street Magistrates court, and seeing all the guys who'd spent a night in the cells for being drunk and disorderly come before the beak, there each of them was "offered" £10 or a day inside. It was made very clear to the people who opted for the £10 that if it wasn't paid in the next 48 hours they would have to serve the day as well as pay the £10.

Hopefully this toe-rag will also have his fine and community service reinvoked, I'm not holding my breath though.

As I said he seemed to insist that he wasn't going to pay so he could get prison instead, and he probbly knows far more about how the justice service works than the majority of us here do.

It seems unfair when compared to a working person who commits a crime and pays because he fears going to prison because it will affect him getting a job etc.

I dont think a lot about the justice system could surprise me though.

Absolute joke but i am no longer surprised or shocked at this sort of thing as it is now a daily routine for many of the scum in society and they have realised the system doesn't really want to deal with them. Yet still on this forum we have some members that say our criminal justice system is too hard you really couldn't make it up.

It just about sums this sad country up, the palce is on it's ass in a big way, we need some Russian prisons in the UK, that will sort the scum out.
