Is it true or did i dream it today that Leslie Ash has been awarded damages of £5 million because she caught MRSA?

compensation for money she would have earned if she had carried on working and loss of earnings since 2004 and compensation for the injury and the fact she is now walking with a stick and I imagine had a pretty active lifestyle beforehand it seems fair. The fact that it is a pre trial settlement indicates that she had a strong case and both parties settled to avoid costs and for the NHS potentially a higher settlement. Perhaps the claim would have been higher if she had not had collagen injections in her lips in 2003 as that must have impacted her earnings during that year.

Yup. From the daily mail (on line):

Miss Ash caught the infection after being admitted to hospital in April 2004 with a punctured lung and two broken ribs.

Her husband was arrested on suspicion of assault but released without charge when she claimed the injuries were sustained during an 'energetic' sex session.

Because 16 years ago the compensation culture was different?
Loss of notes really should not hinder such a case, infact it should help the case because the hospital would then find it much harder to prove they actually did anything to prevent the disability occurring.

How they projected 5 million comp including loss of future earnings I'll never know.

My sister in law was after answers and also some financial help to care for the daughter she has to wash, dress and toilet every day until she dies. she was denied that.
If Leslie ash wasn`t a big celbrity, i doubt she would have got anything at all.

If Leslie ash wasn`t a big celbrity, i doubt she would have got anything at all.
Well I don't know the full details of the case but I am not suprised she did not get answers, I am suprised that she did not get any financial support. If her daughter is likely to outlive her then the court case should be making long term care awards to cover the cost of providing care. In any case there is the lost opportunity to your SIL.
Leslie Ash is 47 and was 43 at the time of the incident, looking back she had a successful career and was undoubtedly well remunerated. Taking that data it is easier to argue what her income going forward might have been, now you can argue it down in that she was a female actor famous for being the hot girl next door type in a sitcom so might have lower earnings potential going forward...
The good thing, or bad thing depending on which way you look at this is that she has raised the bar for compensation in the UK for hospital malpractice and while that does not help your SIL right now it could certainly open the door to having the case re-evaluated and will mean that future cases are looked at with a potentialy larger cheque book where justified.

It will also make hospitals have to think more carefully about saving 10k a year on cleaning costs when the possible downside is a 5m payout.

I wouldnt take £5 million to go through what she's been through with her hospital inflicted pain. It's not just for the income she's lost (I assume) - isn't it also to compensate for the pain and loss of lifestyle?
