Smith was nabbed after stepping off a flight from the Dominican Republic, where he had been operating since May after a federal judge shut down his Minneapolis-based spam businesses, Burnsville Internet and Xpress Pharmacy Direct, and ordered him to stop marketing penis pills and other assorted tat. Smith allegedly sent more than one billion spam emails either to AOL email addresses or through AOL email accounts. The FBI claims Smith, 25, has made approximately $18m this year from his lucrative spam businesses.

I dunno, they have seized assets and closed his company so he may find himself on the receiving end of an inmate who is using his merchandise

The problem with this case is that this guy probably will go to prison.
He goes in a petty criminal, certainly not a major league player when you consider that murderers and rapists are getting off scott free, and will probably come out a hardened criminal.

Where's Nugget?
Well what would be the best sort of punishment for Spammers then?If not jail time what.Seize all their money I suppose but it doesn't seem enough for the time wasting that spam entails, not to mention the expense of firms finding a way not to have their inbox's full of spam.

They shud be given one mailbox, and a computer shud be setup to generate spam to the convicted spam offenders. Who must reply to every mail, miss one inside a set time results in the spam generator sending that offender XX more extra spam, the more they miss the more this increases. The sentence could be something like 1 spam mail per $/£ screwed from victims. They are then free to go once the sentence is completed.
