That may be what had gotten him caught but since the sale and use of mod chips is now illegal that will have also counted against him

It was the games, chipping itself is not illegal, even though sony won a court battle against this in the uk, the chips are now fitted empty, you just flash them at home, same way xbox modchips has allways been, hence why PS2 chips did cease in UK for a small time 
Anyone who loads up a console or any other computer with pirated copyrighted software to gain a sales advantage is a moron and will of course get busted.
