Re: 14 year old to sue council ?

Sounds good to me.

She can sue and claim legal aid (paid for by the tax payers).

Se can get a hefty payout from the council (paid for by the tax payers).

She can then get a coucil house and benefits (Paid for by the tax payers).

And all because she couldn't keep her legs crossed.

God, I think I'd sue

well i think that depends on what type of special needs she has, if she can judgementally make adequate decisions then the case should be thrown out.

Sounds like she can "judgementally make adequate decisions" to me

Re: 14 year old to sue council ?

Remember this girl had special needs hence her being enrolled at a specialist boarding school. As she was not receiving community based support then I would guess quite her disability is quite severe and the council will have had a duty of care which they may not have fulfilled. Will be interesting to see the facts of this case emerge.

But not a direct quote. Beware journalistic habits. It's probably the claim, prepared by an eloquent and educated lawyer, that says that, not her.

She was under 16 that is statutory rape.

See http://www.opsi.gov.uk/acts/acts2003/30042--b.htm especially:

30 Sexual activity with a person with a mental disorder impeding choice

31 Causing or inciting a person, with a mental disorder impeding choice, to engage in sexual activity

I would definitely say that there is a good case for failure of "duty of care".

Re: 14 year old to sue council ?

If she can sue the council then can't the council sue the bloke, he's played his part in all this, come to think of it why doesn't she sue him, or is it a case of more likely to get money out of the council???

But I agree, at her age surely it's rape??? No??
