dead hard disk from ebay - where do I stand?
Just received a hard disk via Royal Mail. It was packed in the skinniest of padded envelopes with no other protection. No bubble wrap, no plastic disk case. Just the bare disk in antistatic bag in this skinny envelope.
Naturally it's DOA. So where do I stand with this as the damage was clearly done in transit. Can I demand a refund on the basis of inadequate packaging?

Yep, I got a couple of 2nd hand DIMMS taped to a bit of cardboard inside of a non-padded envolope and one was DOA so requested a refund which was instantly granted by the seller.
If the disk was sold as working then it's the sellers responsibility to ensure that it reaches you in that condition. If the packaging is not suitable then he's failed in his role. Put in a dispute and see how it goes.

Yep! You should get a refund no problem, raise a dispute with eBay. Takes a while (and is a bit of a pain in the bum!) but its well worth it.

The seller has agreed to refund once I return the disk. I messaged him through ebay and he replied most politely with the offer of a refund. So now I'll wait and see if that proceeds according to plan.

Keep all messages through ebay that way you have a record that ebay CS can see just in case if after a time he reneges on the return

Just what I was about to post! Bought my wife some boots a couple of years back, thu turned out to be fakes. Seller offered refund then began a game of 'silly b#ggers' with me. Every excuse under the sun.. Make sure eBay know what's going on from the get-go!

Take photos of the packaging etc. before sending it so you have evidence of that too.
