Replacement disks and how to get them?

Got my youngest an X-Box 360 with Kinnect for Christmas. COD Black Ops, Medal of Honour, Dance Central and Kinnect Adventures.

She's played COD 3 times and now the disk has a scratch all the way around it making the disk unplayable. The x-box was sat on the floor while she was sat on the bed with her headset on shouting at the tv.
The same thing has happened with Dance Central.

X-Box say the console must have been moved while the disk was spinning which I think is a possibility with Dance Central but not with COD.

Her JLS cd plays fine, we tried Medal of Honour this morning, that played fine too.

Is it her fault?
Are the disks themselves faulty?
Is it possible the x-box has an intermittent fault?
Can she download these games direct to the x-box without having to pay for them again or is there an easy way to get the disks replaced?
I did try the x-box site but found it seriously stressful to navigate.

Any thoughts, opinions or help on this is very much welcomed.

Yep, if the xbox will still read the disks, insert them, hit Y for Game Options and then choose install to Hard Disk. You will still need the disk in the drive to play because of DRM protection, but it will read from the hard drive instead of the CD

Some people have had problems in the past with Xboxes scratching discs, so if the console was not moved then it may be an issue with the drive. I'm surprised to hear of it happening with a new console, though.

Hubby got the scratches out using toothpaste, both disks now playable and installed onto the hard drive
