Bandwidth chewed up somehow

I dont know whats happening. I use p2p software on a 1mb connection (200kbps download 20 kbps upload i think) and for about half the time speeds rocket. Then suddenly my download speed drop to about 20kbps and p2p no longer works. Tried resetting computer and modem but didnt work. Called India at cost of £5 and they told me that the modem responded when cable was out and not when cable was in, prooving (they said there was no doubt) that I was using p2p software. But I had switched the p2p off and restarted computer so how can they say that with certaintly.
Anyone know what could be causing this? Is it a hangover from using p2p that is affecting just my computer despite a clean boot or is NTL to blame?

Is it because you have gone over the download limit between 4pm and 12 midnight?

During peak times, the top 5% on the Size: M package download at least 350MB of traffic each.

Any users hitting this amount during peak times (4pm till midnight) will have their broadband speed temporarily traffic managed – their download speed will be set to 1Mb, with their upload speed set to 128Kb. This will last for 4 hours from when the traffic management policy is applied"

Its back to normal again 15 minutes later. Got my numbers mixed up. Before it was 20 KB/s download and now it is 167 KB/s download. What this means Im not sure as it happens a lot at intervals through the day.

It depends on the peers you are connected to (their downloand speed and availability).

It could be some nasty bug downloaded along with the illegal movies ect

3rd test.
10 mins on and my speed is 51 KB/s but upload is totally fine this time (22 KB/s).
4th test
1 min later and speed is exactly as it should be again.
I wonder if it has anything to do with number of attacks on my firewall? I used to use Zonealarm and it took 100s of mini-hits a minutes - surprised even some of the zonealarm support team. Now use XP but I assume it is just as flooded.

Try dropping your upload to 10KB/s, see if that makes a difference - how many seeds are there in the torrent?

I use Shareaza and Utorrent but I didnt have them on between tests. Though I easily exceed the download limit if i downloading continously at 100 KB/s i work out.
4th test
download: 47 KB/s upload 22 KB/s. down the pan again. Ebbs and flows.

try going to gamefiles.blueyonder.co.uk and download a file from there if you get above 200kb ur connection is fine and again p2p speed depends on what bandwidth other peers can give you
