Stuart C - I think they only rented them out, but when they gave everyone 2 meg for free they advised people to ditch the frog and use a router. They would supply the latter for a fee. Nowadays, after 'max' broadband has been introduced, they supply a home hub (previously a router) with the package.
There was never any suggestion that they wanted the frog modem back. Nowadays, of course, it wouldn't work with 'up to' 8meg BT broadband anyway.

Got it in one.

The modems remain the property of ntl (whether or not they want to exercise their right to retain them and collect them when they lose customers) and they do log which modems are in use.

Connecting an unauthorised modem to the service may well work, chances are it won't, and if it does then effectively it's theft of services because you are using unauthorised equipment.

IANAL but even though it used to say in the T&C that it was up to the customer to return the equipment, after a due period of time I believe NTL lose the right to claim ownership. Round here NTL do not even bother to pick up digital STB's and I know some ex-customers are advised to "throw unwanted kit into a skip" which is itself probably illegal under Eurpean law re safe disposal of commercial electronics.
